Tender no. 83495890 Expert to assess Moldova’s legal framework and propose amendments for enabling Passive House and advanced NZEB implementation


The Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) in Moldova is seeking, under the Energy Efficiency and Renewable Energies in Moldova (E4M) project, an expert to support E4M (GIZ and the National Center of Sustainable Energy – CNED), the Ministry of Energy (MoE) and the Ministry of Infrastructure and Regional Development (MIRD) in conducting an in-depth review of the national legal framework governing the construction sector and building energy efficiency in the Republic of Moldova. This assignment is part of the Passive House for Moldova (PH4M) component, which aims to pilot Passive Houses and advanced Nearly Zero Energy Buildings (aNZEB - a more ambitious interpretation of the national NZEB standard) and to develop a dedicated Moldovan Residential Energy Efficiency Fund (MREEF) financial product for such constructions. The review will identify existing gaps, inconsistencies, and barriers that could hinder the successful implementation of these standards and technologies, and based on this analysis, the expert will provide support in drafting or adapting relevant legal provisions, drawing on best international practices and the experience of EU Member States.

The selected candidate will conduct all the activities in accordance with the provisions of the Terms of Reference (ToR).

Tasks to be performed by the independent consultant: 

  • Desk review of EU member states experiences in policy development regarding the Passive House Standard and other voluntary energy-efficiency schemes above national requirements, analyzing legislation, institutional frameworks, and incentives in Germany, Belgium, Austria, Denmark, and Romania to identify lessons and best practices applicable to Moldova.
  • Review of Moldova’s national legal and regulatory framework governing the construction and energy efficiency sector, including key laws, regulations, Moldovan Construction Norms (NCM) and Guidelines (CP) that may impede the design and construction of Passive Houses. The review will identify potential barriers to voluntary energy-efficiency standards, highlight overlaps or duplications where Passive House compliance may require repeating procedures, and pinpoint gaps or obstacles that could delay or obstruct the implementation of Passive House projects in Moldova. Additionally, the expert will assess whether Class A under NCM M01.02 could become the future minimum energy performance requirement in the forthcoming transposition of Directive (EU) 2024/1275 on the Energy Performance of Buildings.
  • Drafting of relevant legal provisions for the implementation of Passive House and aNZEB standards in accordance with the regulatory assessment.
  • Facilitate coordination and consensus-building among key stakeholders, including the MoE, MIRD, and other relevant authorities, to ensure alignment and ownership of the proposed changes.

The expert should meet the following criteria and qualifications/skills:

  • General qualifications (1.1.1):
  • Education:
  • Bachelor’s or master’s degree in law, preferably with a specialization in construction law, energy law, or environmental regulation.
  • Professional experience:
  • 5 years of proven experience in regulatory analysis, legal drafting, policy advisory, and research or assessment activities in fields related to construction, energy efficiency in buildings, or environmental protection.
  • Experience in approval procedures related to policy and regulatory documents in the Republic of Moldova;
  • Experience in the region/knowledge of the country (1.1.2):
  • Familiarity with international and EU legal frameworks, including the Energy Performance of Buildings Directive (EPBD) and related EU Green Deal legislation.
  • Language (2.2.2): C2 - level language proficiency in Romanian; C1 - level language proficiency in English;

 The successful application shall include:

1.     Detailed CV as described in the TOR (will not exceed four pages).

  1. Financial Proposal (in a separate document) containing the gross daily rate in MDL (and respective total amount per 50 workdays of assignment) and the total budget in MDL.
