Extended Deadline: Local consultant to build capacity of SCM in the area of judicial selection and discipline

USAID-funded Open Justice Project

Millennium DPI Partners, LLC is an international development firm based in the United States of America, which is implementing the USAID-funded Open Justice Project in Moldova. Open Justice will assist the Government of Moldova to improve the efficiency and transparency of the Moldovan judicial system and improve access to justice for citizens of Moldova.

Millennium DPI Partners, LLC, through the Open Justice Project, under Objective 2, will conduct activities to increase the capacity of the SCM to adopt more efficient and transparent decisions on selection of judicial candidates and career of judges and promote fair, transparent and accountable disciplinary proceedings, strengthening JIB/JD operational capacity, and improving judicial performance.  

With this aim, Millennium DPI Partners, LLC is seeking a qualified local consultant to develop, between June – August, 2018, guidelines and templates for well-reasoned SCM decisions on judges’ selection and improve SCM’s publicly available resources on judicial disciplinary proceedings.

The Local Consultant’s Tasks and Responsibilities:

  • Develop a template for mandatory use by the SCM to draw-up well-reasoned decisions on judges’ selection and promotion;
  • Develop necessary guidelines for the SCM members to draw-up well-reasoned decisions;
  • Assess the proposed amendments to the regulatory framework to ensure well-reasoned decisions on selection of judges and deliver conclusions and recommendations for improvement;
  • Organize and lead a 1-day round-table for SCM members on selection decisions reasoning;
  • In cooperation with the Open Justice’s International Consultant, develop proposals for improvement of the content of SCM’s (DB and JIB) publicly available resources, in particular:
  • Assess the existing regulatory framework on judges’ disciplinary liability and clarify effects on the content of the online resources that will be available to the public on the SCM website;
  • Assess the proposed online templates for uploading the citizens’ petitions and notifications according to Moldovan legal framework on disciplinary liability of judges;
  • Develop the format for electronically signed notifications reflecting legal requirements;
  • Develop an online guide for the general public on completion and submission of the above-mentioned templates and notifications;
  • Develop easy to read guidelines for petitioners related to disciplinary proceedings (what constitutes a disciplinary offence, an ethical issue, a court management issue, what are the disciplinary proceedings etc.);
  • Prepare the content for an FAQs on disciplinary proceedings to be uploaded on the SCM webpage.
  • Finalizing and delivering the Final Report on activities.

Local Consultant Eligibility Criteria:

  1. Master degree in law, human rights or other relevant subject areas.
  2. At least 10 years of professional experience in the area of law/jurisprudence/legislation related to judiciary.
  3. Excellent written, communication, presentation and team work skills.
  4. Proven legal drafting skills.
  5. Comfortable working as part of a team to add value to collective results.
  6. Good command of Romanian and English both oral and written.
